Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you (“you,” “Customer”) and Sure Translation (“Sure Translation,” “Company,” “we,” “us,” “our”) governing your access to and use of https://www.suretranslation.com/ (the “Site”) and any services, features, content, and related communications we provide (collectively, the “Service”). BY ACCESSING OR USING THE SERVICE, OR BY PLACING AN ORDER, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE. 1) ELIGIBILITY; AUTHORITY You represent that you are at least the age of majority in your state/province of residence and have the legal capacity to enter into these Terms. If you use the Service on behalf of a business or other entity, you represent you have authority to bind that entity, and “you” includes that entity. 2) CHANGES TO TERMS; SERVICE CHANGES We may update these Terms at any time by posting an updated version on the Site. Unless otherwise stated, changes are effective upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We may modify, suspend, or discontinue any part of the Service at any time without notice. Prices and offerings may change at any time. 3) DEFINITIONS “Deliverables” means translated files, certificates of accuracy/certification statements, and any other outputs we provide. “Order” means your purchase request for translation and related services through the Service. “Source Materials” means the documents, images, text, or files you submit for translation. “USCIS” means U.S. Citizenship and Immigration Services. 4) ORDERS; ACCOUNT; BILLING 4.1 Order Placement. When you place an Order, you agree to provide accurate, current, and complete information (including contact and billing details). You authorize us (and our payment processors) to charge your payment method for the total amount displayed at checkout, including applicable taxes/fees (if any). 4.2 Refusal/Cancellation by Us. We may refuse or cancel any Order at any time for any reason, including suspected fraud, pricing errors, policy violations, or operational limitations. If we cancel an Order, we will attempt to notify you using the information you provided. 4.3 Chargebacks. You agree not to initiate a chargeback or payment dispute without first contacting us at support@suretranslation.com and giving us a reasonable opportunity to resolve the issue. Excessive chargebacks may result in account restrictions and/or refusal of future Orders. 5) DELIVERY; TURNAROUND; REVISIONS 5.1 Delivery Method. Deliverables are provided digitally, typically by email and/or via a secure download link. 5.2 Turnaround Times. Unless expressly stated otherwise at checkout or in a written confirmation from us, standard delivery is typically between 1 to 3 business days after Order placement. Priority/expedited Orders are typically delivered by the next business day after Order placement. Turnaround times are estimates and may vary due to language pair, document quality, complexity, volume, and operational factors. 5.3 Revisions. We are committed to your satisfaction. If you believe there are issues with the Deliverables, you may request revisions. Unless otherwise specified in writing, revision requests should be submitted within 30 days of delivery and should include specific details (e.g., page, line, and requested correction). We may request clarification or additional information to process revisions. 6) FULFILLMENT POLICY; NO RETURNS; LIMITED CANCELLATION 6.1 No Returns. Because translation services are digital and begin promptly after ordering, returns are not applicable. 6.2 No Refunds Once Work Begins. Due to the specialized nature of translation services and immediate resource allocation, ORDERS ARE NON-REFUNDABLE ONCE WORK HAS BEGUN. By placing an Order, you acknowledge and agree that you will not receive a refund once work has started. 6.3 No Cancellation After Placement. Orders may not be cancelled after they have been placed because we allocate resources and incur costs as soon as an Order is received and assigned. 7) USCIS TRANSLATION ACCEPTANCE GUARANTEE (LIMITED REMEDY) 7.1 Guarantee Scope. For Orders marketed as “USCIS certified translation,” we guarantee that the translation Deliverables are prepared to meet USCIS certified translation requirements, including provision of a certification statement/certificate of accuracy. 7.2 Limited Remedy – Revisions Only. In the unlikely event USCIS rejects the translation due to translation-related issues, our sole obligation and your exclusive remedy under this Guarantee is to provide revisions to the translation Deliverables until accepted by USCIS, subject to the conditions below. THE GUARANTEE DOES NOT INCLUDE REFUNDS OR REIMBURSEMENT OF USCIS FEES, FILING FEES, LEGAL FEES, TRAVEL COSTS, LOST TIME, LOST OPPORTUNITY, OR ANY OTHER DAMAGES OR COSTS. 7.3 Eligibility and Proof. To qualify, you must provide substantial proof that USCIS rejected the translation due to translation issues, such as an official USCIS rejection notice stating that the reason relates to translation. 7.4 Time to Submit Claim. You must submit a claim under this Guarantee within 30 days of our delivery of the translation. 7.5 How to Submit Claim. Email support@suretranslation.com with the subject line “USCIS Rejection Claim” and include your full name, Order number, a copy of the USCIS rejection notice, and a detailed explanation of the issue. We may request additional information to validate the claim. 7.6 Exclusions. The Guarantee covers only the Deliverables we provided. It does not apply to: (a) issues caused by incomplete/illegible/altered Source Materials, (b) incorrect information you provided (including names, dates, locations, identifiers), (c) changes you or a third party made to the Deliverables, (d) rejection reasons unrelated to translation (e.g., missing forms, filing issues), or (e) requirements outside standard USCIS certified translation requirements. 8) CUSTOMER RESPONSIBILITIES; SOURCE MATERIALS 8.1 Accuracy and Completeness. You are responsible for providing complete, accurate, legible, and unaltered Source Materials and instructions. Poor-quality scans/photos, missing pages, handwritten content, or unclear text may impact accuracy and turnaround time. 8.2 Review Before Use. You are responsible for reviewing Deliverables before submission or use and notifying us promptly of any suspected errors or concerns. If you discover an issue, you agree to allow us a reasonable opportunity to correct it through revisions before you submit or rely on the Deliverables where practicable. 8.3 Sensitive Information. You are responsible for deciding what information to submit. While we employ security measures, you acknowledge that no system is perfectly secure. 9) TRANSLATION-SPECIFIC DISCLAIMERS; NO RELIANCE; LIMITATION FOR INACCURACY 9.1 Translation Is Not Professional Advice. Translations are linguistic services and are not legal, immigration, medical, financial, or other professional advice. You are solely responsible for obtaining independent professional advice as appropriate for your situation. 9.2 No Guarantee of Outcomes. WE DO NOT GUARANTEE ANY SPECIFIC OUTCOME, ACCEPTANCE, OR RESULT FROM ANY GOVERNMENT AGENCY, COURT, SCHOOL, EMPLOYER, OR OTHER THIRD PARTY, EXCEPT AS EXPRESSLY STATED IN SECTION 7 (USCIS GUARANTEE), WHICH PROVIDES ONLY A LIMITED REVISION REMEDY. 9.3 Inherent Language Ambiguity. Language may be ambiguous and context-dependent. Even when performed with care, translations can involve judgment calls (e.g., formatting, transliteration, proper nouns, and equivalence). You agree that any use of the Deliverables is at your own risk. 9.4 Limitation for Inaccurate Translation Claims. TO THE FULLEST EXTENT PERMITTED BY LAW: (a) SURE TRANSLATION WILL NOT BE LIABLE FOR CLAIMS OR LOSSES ARISING FROM OR RELATING TO (i) INACCURATE, INCOMPLETE, ILLEGIBLE, MISLEADING, OR ALTERED SOURCE MATERIALS, (ii) INSTRUCTIONS PROVIDED BY YOU OR ANY THIRD PARTY, (iii) YOUR FAILURE TO REVIEW THE DELIVERABLES BEFORE USE, OR (iv) CHANGES MADE BY YOU OR ANY THIRD PARTY TO THE DELIVERABLES; and (b) FOR ANY CLAIM THAT A DELIVERABLE CONTAINED AN ERROR OR INACCURACY, YOUR EXCLUSIVE REMEDY IS CORRECTION THROUGH REVISIONS (AND, IF APPLICABLE, THE LIMITED USCIS GUARANTEE IN SECTION 7). YOU WAIVE ANY CLAIM FOR DAMAGES BASED ON DECISIONS OR ACTIONS TAKEN IN RELIANCE ON A DELIVERABLE, INCLUDING CLAIMS FOR USCIS OR OTHER AGENCY FEES, RE-FILING FEES, PENALTIES, INTEREST, LOST WAGES, LOST PROFITS, LOST BUSINESS, LOSS OF OPPORTUNITY, OR DELAYS. 9.5 Third-Party Requirements. Different recipients may have unique formatting/certification requirements. Unless expressly agreed in writing, we do not guarantee compliance with requirements beyond standard certified translation practices for the intended use. 10) ACCEPTABLE USE; PROHIBITED CONDUCT You agree not to use the Service or Site content: (a) for any unlawful purpose; (b) to violate any laws, regulations, or ordinances; (c) to infringe intellectual property rights (ours or others’); (d) to harass, abuse, defame, threaten, or discriminate; (e) to submit false or misleading information; (f) to upload or transmit malware or destructive code; (g) to scrape, crawl, harvest data, or interfere with the Service’s security features; (h) to spam, phish, or attempt unauthorized access; or (i) in any way that could damage or impair the Service or other users. We may suspend or terminate access for any violation. 11) USER SUBMISSIONS; FEEDBACK If you submit ideas, suggestions, or feedback, you agree we may use them for any purpose without compensation or obligation. You represent you have rights to submit any content you provide and that it does not violate any third-party rights. 12) THIRD-PARTY TOOLS; LINKS; PAYMENT PROCESSORS We may provide access to third-party tools or links. We do not control, monitor, or endorse third-party services and are not responsible for them. Your use of third-party services is at your own risk and subject to those third parties’ terms and policies. Payments may be processed by third-party payment processors. 13) INTELLECTUAL PROPERTY The Site and its content (excluding your Source Materials) are owned by Sure Translation or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or exploit any portion of the Service without our express written permission. 14) PRIVACY; SECURITY We collect and use personal information to provide and improve the Service, process Orders, deliver Deliverables, respond to support requests, and communicate with you. We use commercially reasonable measures to protect personal information, but no method of transmission or storage is 100% secure. By using the Service, you acknowledge and accept these risks. 15) DISCLAIMER OF WARRANTIES THE SERVICE AND ALL DELIVERABLES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. 16) LIMITATION OF LIABILITY; DAMAGES WAIVER; LIABILITY CAP 16.1 Damages Waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SURE TRANSLATION OR ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE, ANY ORDER, ANY DELIVERABLE, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. 16.2 Liability Cap. TO THE FULLEST EXTENT PERMITTED BY LAW, SURE TRANSLATION’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE, ANY ORDER, ANY DELIVERABLE, OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SURE TRANSLATION FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US $100). 16.3 Basis of Bargain. You acknowledge that the limitations in this Section 16 are an essential basis of the bargain and apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise). 16.4 Jurisdictional Limitations. Some jurisdictions do not allow certain limitations; in such cases, limitations apply to the maximum extent permitted by law. 17) INDEMNIFICATION You agree to indemnify, defend, and hold harmless Sure Translation and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claims, demands, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your breach of these Terms; (b) your Source Materials, your instructions, or information you provided (including claims that Source Materials were incorrect, incomplete, illegible, or unlawfully provided); (c) your use of, reliance on, distribution of, or submission of Deliverables (including any claims brought by third parties, recipients, or agencies relating to your use of Deliverables); (d) your violation of any law or the rights of any third party; or (e) your misuse of the Service. We may assume exclusive control of the defense of any matter subject to indemnification, and you agree to cooperate with our defense. 18) TERMINATION We may terminate or suspend your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason. Obligations and liabilities incurred before termination survive termination. 19) TIME LIMIT TO BRING CLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM ACCRUES; OTHERWISE, IT IS PERMANENTLY BARRED. 20) FORCE MAJEURE We are not liable for any delay or failure to perform due to events beyond our reasonable control, including acts of God, natural disasters, pandemics, labor disputes, internet/hosting outages, governmental actions, war, terrorism, civil disturbances, supply chain disruptions, or power failures. 21) GOVERNING LAW Except as preempted by the Federal Arbitration Act for arbitration matters, these Terms and any disputes arising out of or relating to these Terms or the Service are governed by the laws of the State of Delaware, without regard to conflict of law principles. 22) DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. 22.1 Informal Resolution Required. Before initiating arbitration or a court proceeding (except as allowed below), you agree to send a notice describing the dispute (“Dispute Notice”) to support@suretranslation.com with the subject line “Dispute Notice,” and allow 30 days for informal resolution. You agree to cooperate in good faith. 22.2 Binding Arbitration. If the dispute is not resolved within 30 days after receipt of a Dispute Notice, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, any Order, communications between you and us, or the relationship between you and Sure Translation (collectively, “Dispute”) will be resolved by binding arbitration on an individual basis, rather than in court, except as expressly provided in Section 22.4. 22.3 Federal Arbitration Act. These Terms evidence a transaction involving interstate commerce. The Federal Arbitration Act (9 U.S.C. §§ 1–16) governs the interpretation and enforcement of this arbitration agreement. 22.4 Exceptions. (a) Small Claims. Either party may bring an individual action in small claims court if it qualifies and remains in that court. (b) Injunctive/Equitable Relief for Misuse and IP. Sure Translation may seek temporary, preliminary, or permanent injunctive or other equitable relief in any court of competent jurisdiction to protect its confidential information, intellectual property, systems, and to prevent unauthorized use, scraping, fraud, abuse, or security threats. This does not waive the obligation to arbitrate any other Dispute. 22.5 Administrator and Rules. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (if applicable) or otherwise the AAA Commercial Arbitration Rules, as modified by these Terms. 22.6 Location and Format. Arbitration may be conducted by video, phone, written submissions, or in-person. If an in-person hearing is required, the hearing will take place in Wilmington, Delaware, unless the arbitrator determines another location is appropriate for fairness and convenience. 22.7 Individual Basis Only; Class Action Waiver. ALL DISPUTES MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITIES ONLY. THE PARTIES AGREE NOT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION OR PROCEEDING. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim. 22.8 Jury Trial Waiver. To the fullest extent permitted by law, you and Sure Translation waive any right to a jury trial for any proceeding arising out of or relating to these Terms or the Service. 22.9 Delegation; Arbitrator Authority. The arbitrator has exclusive authority to resolve any Dispute, including the interpretation, applicability, enforceability, or formation of this arbitration agreement, except that a court may decide the enforceability of the Class Action Waiver to the extent required by law. 22.10 Fees and Costs. Payment of arbitration fees will be governed by AAA rules and applicable law. Each party bears its own attorneys’ fees and costs unless the arbitrator awards otherwise under applicable law. 22.11 Confidentiality. The parties agree to keep the arbitration (including filings and awards) confidential except as necessary to conduct the arbitration, enforce an award, or as required by law. 22.12 Severability. If any portion of Section 22 is found unenforceable, it will be severed and the remainder enforced to the fullest extent permitted by law. If the Class Action Waiver is found unenforceable as to a particular claim, that claim will proceed in court (not arbitration), and only that claim. 22.13 Opt-Out. You may opt out of arbitration by sending an email to support@suretranslation.com within 30 days of first accepting these Terms, stating your name, the email address used for your Order/account, and a clear statement that you are opting out of arbitration. If you opt out, disputes will be resolved in court (subject to applicable law), and Section 22 will not apply. 23) ELECTRONIC COMMUNICATIONS You consent to receive communications from us electronically (e.g., by email or website notices). You agree that electronic communications satisfy any legal requirement that such communications be in writing. 24) ASSIGNMENT; NO THIRD-PARTY BENEFICIARIES You may not assign these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, corporate reorganization, or sale of assets. These Terms do not create any third-party beneficiary rights. 25) SEVERABILITY; WAIVER; ENTIRE AGREEMENT If any provision of these Terms is held unlawful or unenforceable, that provision will be enforced to the fullest extent permitted by law and the remainder will remain in effect. Our failure to enforce any right or provision is not a waiver. These Terms, together with any policies or notices posted on the Site regarding the Service, constitute the entire agreement between you and Sure Translation and supersede prior agreements and communications. 26) CONTACT Questions about these Terms should be sent to: Sure Translation Email: support@suretranslation.com

Fulfillment Policy

Due to the specialized nature of translation services, we are unable to issue refunds once an order has been placed. Our team starts working on your project immediately, incurring costs that cannot be recovered. All translated documents will be sent to the customer's email address. The email will contain a secure Google Drive link where all the relevant documents can be downloaded. For standard orders, the delivery timeline is between 1 to 3 business days from the date of order placement. Priority orders are expedited and will be delivered by the next business day following the order placement. As we deal with virtual goods and services, returns are not applicable. However, we are committed to your satisfaction. If the translated documents are not accepted by the USCIS or you find any issues, we offer unlimited free revisions within 30 days from the date of document delivery. Orders may not be cancelled after they have been placed. This is because we allocate resources and initiate costs as soon as the order is placed and assigned to our translation team.
